Terms of service.

Plain English, as far as a contract can be. What you get, what you pay, what you own, and what a YachtGrade report is and is not.

These terms are the agreement between FC Works LLC, a Florida limited liability company ("we", "us"), and the business that signs up for YachtGrade™ ("you"). By creating an account or using YachtGrade, you accept them on behalf of your business, and you confirm that you are at least 18 and allowed to accept them for it.

1. What YachtGrade is

YachtGrade is software for businesses that inspect and look after boats: checklists, photographs, scores, reports, maintenance records, QR code guides and scheduling. It is a tool your business uses. We do not inspect boats, we do not advise your clients, and we are not a party to the work you do for them.

2. A report is not a survey

A YachtGrade report records what your people checked and photographed, and when. It is a condition and readiness report. It is not a marine survey, it is not carried out by an accredited surveyor, and it is not a substitute for a pre-purchase, insurance or damage survey.

The health score is worked out from the answers your people give. It is not a valuation and not a promise about a boat's condition. You are responsible for the checks your business carries out, the findings it records and what it tells its clients.

3. Your account and your people

You can invite as many people as you like and decide what each of them can see and do. You are responsible for what they do in your account, for keeping sign in details private, and for removing people who should no longer have access. Tell us at support@yachtgrade.com if you think someone has used your account without permission.

4. The free trial

A trial lasts 30 days, covers up to 3 boats and needs no card. When it ends you cannot add boats until you subscribe. The records you created during the trial stay in your account.

5. Prices and billing

The price is per boat, per month, with a monthly minimum, as published on our pricing page on the day you subscribe. Every boat on your account counts, including boats you have archived. You can pay monthly or yearly, in advance, through our payment processor, Stripe. Prices do not include taxes, which are added where they apply. Your subscription renews automatically until you cancel it.

Your price is locked for five years. The rate you subscribe at applies to every boat on your account for five years, for as long as your subscription runs without a break. If our published price goes up, yours does not.

6. Cancelling

You can cancel at any time. Cancelling takes effect at the end of the period you have already paid for. Payments are not refundable for part of a period, except under the guarantees and promises in section 7 or where the law requires it.

7. Our guarantees and promises

Each guarantee below counts from your first payment, not from the start of your free trial.

  • The One-Visit Guarantee. If the report from your first check on a real boat is not one you would send an owner, tell us within 30 days of your first payment and we will refund your first paid month.
  • The Owner-Noticed Guarantee. If you send a report after every visit, for at least three boats, for the first 60 days, and not one owner opens a report and replies, calls or approves work because of it, tell us within 14 days after those 60 days and we will refund every month you have paid.
  • The Paid-For-Itself Guarantee. If your reports do not win you at least one approved repair in the first 90 days, tell us within 14 days after those 90 days and we will refund every month you have paid.
  • No tech needs training. If any of your people needs training to run a check, tell us within 30 days of the end of that month and we will refund that month.
  • Your records are never held hostage. Whatever happens to YachtGrade, you get every boat, photo, check and report, in files that open without us. Ask at any time and we will send them within 30 days of the request.

To use any of these, email support@yachtgrade.com from the email address on your account. We take your word for whether a guarantee's result happened. Refunds under this section never add up to more than you have paid us, and each guarantee can be used once by each business.

8. Your data belongs to you

You own everything your business puts into YachtGrade: boats, photographs, checks, reports, documents and the contact details of your clients. You give us permission to store and process it only so that we can run YachtGrade for you, which includes using the service providers listed in our privacy policy. We do not claim ownership of it and we do not sell it. Other businesses on YachtGrade cannot see it.

You are responsible for having the right to add your clients' details, and for getting any consent the law requires before YachtGrade sends them a text message or an email on your behalf.

9. Things you share by link

Some things in YachtGrade are made to be opened by people without an account: report links, QR code guides and calendar feed links. Anyone who has one of these links can open it. You decide what is shared and with whom. You can revoke a report link and change what a QR code shows, and a boat's QR codes stop working when she is marked as sold. A calendar feed link shows scheduled visits and berth addresses, so keep it private.

10. Features that read documents

Some features use AI to read documents you upload, such as an owner's manual or a service invoice, and suggest what to record. Those suggestions wait for one of your people to confirm them. Check them before you rely on them.

11. Using YachtGrade properly

Do not use YachtGrade to break the law, to upload material you have no right to use, to send messages people have not agreed to receive, to interfere with the service or other customers, to probe or copy the software, or to resell access to it.

12. Availability

We work to keep YachtGrade running, but we do not promise it will always be available or free of errors. Photographs taken without a signal are kept on the device until they can upload, so let the app finish uploading before you clear its data or change phones. We may change, add or remove features over time.

13. Our property

The software, its design and the YachtGrade™ name and mark belong to FC Works LLC. If you send us suggestions, we may use them without owing you anything.

14. Ending the agreement

You can stop using YachtGrade at any time. We may suspend or close an account that is not paid or that breaks these terms, and we will give notice first where it is reasonable to. When an account ends, you can ask us to export your data or to delete it, and we will do either within 30 days of the request.

15. No warranties

YachtGrade is provided as it is and as available. To the extent the law allows, we make no promises beyond those in these terms, including any promise that it is fit for a particular purpose. We are not responsible for the condition of any boat, or for the decisions your business or its clients make.

16. Limits on liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or revenue, lost data, or damage to any boat or property. Our total liability for any claim about YachtGrade is limited to the amount you paid us in the 12 months before the claim.

17. Claims about your work

If someone makes a claim against us because of the work your business did, the data it added, or the way it used YachtGrade, you will cover our reasonable costs of dealing with it.

18. Florida law

These terms are governed by the laws of the State of Florida. Any dispute will be heard in the state or federal courts located in Broward County, Florida.

19. Changes to these terms

We may update these terms. When we do, we will change the date at the top, and we will email the owner of each account about any change that matters. Using YachtGrade after a change takes effect means you accept it.
